Contest Period: The Contest begins on June 27, 2013 and ends at 11:59:59 pm PT on July 28, 2013 (the "Contest Period"). On or about July 28, 2013, a winner will be named, from among all eligible entries received during the Contest Period to select the Prize winner and the Prize winner will be notified as set forth below.
Eligibility: Must be at least eighteen (18) years of age as of the date of their entry who register for the drawing by entering an online form or filling out a manual entry form. The online form can be found here: http://woobox.com/otc8ks. Employees of Sponsor, and any of Sponsor's respective instructors, affiliates, subsidiary companies, advertising and promotion agencies, or legal advisors (collectively the "Contest Entities") and members of their immediate families (spouses, parents, children and siblings, and their respective spouses, regardless of where they reside), and/or those living in the same household of each (whether or not related thereto) are not eligible to enter or win the Contest. Void outside the U.S. or where otherwise prohibited or restricted by law. By entering the Contest, entrants represent that they have read these Official Rules, and are bound by and agree to these Official Rules and any decisions of Sponsor, which are final and binding in all regards. Winner must be able to prove authorship of portrait.
How to Enter: Just like our page and submit a .JPG of your best Portrait to enter. The portrait will be made available for Facebook users on the contest page and Facebook users will be able to cast votes until the contest end. The winner will be named by popular Facebook vote on or about July 28, 2013.
Limit: An entrant may enter an unlimited amount of art portraits into the Contest throughout the Contest Period. Entries generated by a script, macro, bot or any other automated means will be deemed void. Entries that are submitted through Contest clubs or similar methods or those that are mechanically reproduced, copied, incomplete, or inaccurate are void. All entries must be received by 11:59:59 pm PT on July 28, 2013 to be eligible. The computer clock of Sponsor is the official timekeeping device for the Contest. All entries become the property of Sponsor and will not be returned. Sponsor will not verify receipt of entries.
Prizes and Approximate Retail Value ("ARV"): One Prize winner will be selected. One Prize winner will receive a year long scholarship to the Online Art School with Justin BUA with an approximate retail value (“ARV”) of $249 (Two Hundred Forty-Nine).
Prize Conditions: All prize details are at Sponsor's sole discretion. In no event will Sponsor be responsible for awarding more than the stated number of prizes. Sponsor reserves the right to substitute a prize (or any portion thereof) with another prize of greater or comparable value, as determined by Sponsor. Actual value of prizes depend on any fluctuations in current market conditions at time of prize fulfillment, and any difference between the stated ARV and the actual value, if any, will not be considered. Prizes are non-transferable and no substitutions or cash awards are allowed, except at the sole discretion of the Sponsor. Prizes are non-refundable. Prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. Prize must be used by Prize winner with one (1) year of award. Each winner must have or will need to create an Artistworks.com account in order to redeem the prize awarded. Use of the Membership Plan will be subject Artistworks standard terms, conditions and restrictions for membership.
Odds of Winning: Odds of winning the prize are dependent upon the total number of portraits submitted and the votes your art portrait received throughout the Contest Period.
Prize Notification: On or about July 28, 2013, the Prize winners will be determined by which portrait received the most Votes, from all eligible entries received throughout the Contest Period. The decisions of Sponsor are final and binding on all matters relating to this Contest. All Prize winners are responsible for all federal, state and local taxes. A single entrant is not eligible to win more than one prize. The potential winners selected must comply with these Official Rules in order to accept a prize and be confirmed as an official winner. Sponsor will attempt to notify the potential winners by email, beginning on or about July 28, 2013. As a condition of being named a Prize winner, winners may be required to sign and return, within seven (7) calendar days of notification attempt (or less if a time is specified by Sponsor) an Affidavit of Eligibility, Publicity (where legal) and Liability Release ("Release"), or, potential Prize winner may simply be required to verbally accept prize, agree to the terms and conditions of these rules and confirm information for enrollment in the discretion of Sponsor. Sponsor will attempt to contact the potential winners two (2) times during the above referenced seven (7) day period. If notification attempts for a potential Prize winner fail for any reason, or if a potential Prize winner does not comply with these Official Rules, or Sponsor’s directions upon notification, such prize may be forfeited and an alternate potential Prize winner will be selected by choosing the remaining eligible entry with the most votes, if any, at Sponsor’s sole discretion. Acceptance of a prize constitutes permission for the Sponsor and its designees to use the name, actual likeness, and/or biographical information of a Prize winner in connection with the Contest and the exploitation thereof (including, without limitation, for advertising and promotional purposes) in perpetuity, throughout the universe, in all media whether now known or hereafter devised, without additional compensation unless prohibited by law. Further, acceptance of Prize authorizes the posting of winner’s name on Sponsor’s web site so as to identify winner for purpose of these Official Rules.
General Rules: By entering the Contest, entrants agree to be bound by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. In the event of a dispute over the identity of a selected winner, the natural person who is the authorized account holder of the email address used to submit the entry will be declared the winner. "Authorized account holder" of an e-mail address is defined as the natural person who is assigned to an email address by an Internet Access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Contest. Sponsors will not share email addresses, but may contact entrants for promotional offers from time to time.
Limitations of Liability: Entrants, by participating in the Contest, release and agree to hold the Contest Entities and Facebook Inc. harmless from and against any and all liability, claims or action of any kind whatsoever for any injuries, losses or damages of any kind to persons, including death and bodily injury, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, including participating in this Contest or in any Contest-related activity, whether sponsored, held by, or paid for by a third party or by Sponsor. Each entrant agrees to indemnify Contest Entities from any and all liability resulting or arising from the Contest and to hereby acknowledge that Contest Entities have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize herein. Additionally, the Contest Entities are not responsible for late, lost, stolen, incomplete, misdirected, garbled, damaged, delayed or undelivered entries; or for any virus contracted by an entrant's computer through participation in the Contest, for any incorrect or inaccurate information, whether caused by computer or Internet malfunction or interference, tampering, manipulation, weather or natural disaster, acts of war, or by any of the equipment or programming associated with or utilized in the Contest and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation; or for failed computer, satellite, telephone, wireless or cable transmissions, lines or technical failure or jumbled, scrambled, delayed or misdirected transmissions, technical error, theft or destruction or unauthorized access. Contest Entities are not responsible for other errors or difficulties of any kind whether human, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the notification of potential winners, or in any Contest-related materials. The Contest Entities are not responsible for lost, interrupted or inaccessible or unavailable network, server, wireless service, Internet Service Provider, website, or other connections or any combination thereof. Sponsor reserves the right, at its sole discretion, to disqualify any individual it suspects of tampering with the entry process or the operation of the Contest, to be acting in violation of the Official Rules, or to be acting in a unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any person or entity. Any use of robotic, automatic, macro, programmed or like entry methods or third-party software or website or any other devices which subvert the entry process will void all entries by such methods, and disqualify any entrant using such methods. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. If, for any reason, the Contest is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, fraud, technical failures, virus, bug, worms, unauthorized human intervention or any other causes which Sponsor, in the sole opinion of Sponsor, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and post notice where and how Sponsor sees appropriate.
UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO ATTORNEY FEES. IN NO EVENT SHALL SPONSOR BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE AWARDED TO THE INDIVIDUAL ENTRANT IN THIS CONTEST. SPONSOR'S FAILURE TO ENFORCE ANY PROVISION IN THESE OFFICIAL RULES WILL NOT BE DEEMED A WAIVER.
Disputes, Governing Law and Venue: The Contest is governed by and will be construed in accordance with the laws of the State of California and the forum and venue for any dispute shall be in the state or federal courts covering Napa, California.
Privacy Policy: Any personally identifiable information collected during this Contest will be collected by Sponsor and used by Sponsor for purposes of the proper administration and fulfillment of the Contest as described in these Official Rules and in accordance with Sponsor's Privacy Policy as stated at http://www.artistworks.com/artistworks/tos and as otherwise allowed by law and these Official Rules. By entering you agree to receive periodic information from sponsors of this contest.
